Questions re UC Online Claim Account etc

Hello, I would so appreciate some info on various questions I have - I don't mind at all if the answer is in another post and you want to post that link in...my head is too fried to wade through lots of posts.

1) Does our specific Work Coach book our Jobcentre Interview or someone else? My journal says it was done by “agent”. Reason being, I had quoted in my journal entry from the CAB Going to your Universal Credit interview - Citizens Advice webpage that they say that, “You can either have the interview at the Jobcentre or over the phone.” And on the CAB’s Applying for Universal Credit - Citizens Advice webpage, they say that, “If [verifying my ID online] doesn’t work, can confirm [my] identity in person at the Jobcentre or on the phone.” Plus it says
If you'll find it difficult to go to your interview because you're ill or disabled
You can ask the Jobcentre to change things to make it easier for you - this is called a ‘reasonable adjustment’. For example, you can ask them:
to move your interview to a place you can get to more easily
to have a phone interview

Then I had listed how my physical/mobility disabilities need to be accommodated under the Equality Act 2010 with my being given a phone interview. This has been ignored by my being given a f2f interview. The documents listed in my To Do list seem to be all about ID, nothing else. I am wondering if someone else booked this appt without first reading my journal entries? Since the CAB are paid by the DWP to give us accurate info, surely our Work Coach cannot ignore this phone option? (I’d also quoted case law UA – 2021 – 001444 – ULCW/Regulation 19 of the UC Transitional Provisions Regulations 2014 that I’ve previously passed the WCA therefore my ESA SG status has to be transferred to UC LCWRA immediately from the beginning and paid the extra element. And my Claimant Commitment should read ‘No work-related requirements’).

Have you tried phoning the UC Helpline on 0800 328 5644?

If they are asking for confirmation of your identity then your claim will not be moved forward until it is received, this includes the transfer of your ESA SG status.

Hi Gordon

My head still struggles on the phone; some days it is impossible for me to speak by phone. And even in our UC online account, it says our first means of communicating should be via our journal. So no, I haven't phoned the helpline - I've just made another journal entry and requoted, requesting it be changed to a phone interview (because the CAB site clearly states that ID verification can be done by phone). Hopefully, this will be read/actioned before the f2f date.

2) Is our UC "case worker" the same thing as an ESA 'Decision Maker', or is our Case Worker more of a managing role liaising with our Work Coach and DM and updating claimants?

Yes, this can get confusing as we often refer to people able to make some but not all Decision with the same terms as we do Decision Makers which is actually a job role in the DWP.

So, your Case Worker is primarily there to manage your claim to whatever degree is necessary, they may recommend Decision be made but I would not expect them to have the authority to do this on their own.

3) FOR CLAIMANTS WITH LCWRA STATUS:
I’ve quoted Reg 19 twice in my journal, incl that there should be no automatic requirement for me to undergo a new WCA, and although my Work Coach has not responded to any of my entries, my Case Manager has assured me that the Work Coach can see all the same info that the Case Manager can see.
What is the PURPOSE of the phone ‘First Commitment’ appt with our Work Coach? I can’t find info on this in any guides for LCWRA status claimants. If our Claimant Commitment should only read ‘no work-related requirements’, what is there to discuss?

When I turned up for my first ESA f2f years ago I was so naiive and ignorant – and it cost me badly. So I want to prepare as much as possible – because with the DWP, ‘after the event’ is usually too late and results in deterioration of symptoms due to the stress/strain of ‘fighting’ for what I’m entitled to, but don’t know how to without written guidance? I can’t see that there are many health-related questions that the Work Coach is legitimately allowed to ask us?...most would fall under ‘assessment’ which they are not allowed to do under Reg 19.
The online claim form asks us to list our conditions; asks, “Are you recovering from, receiving or expecting to receive any medical treatments?”; and “What treatment are you receiving?” – there are many illnesses where treatment only ‘manages’ the condition, doesn’t ‘treat’/cure it, and therefore our answer to ‘treatment’ is not going to provide the Work Coach with a date by when we’ll be able to start doing work-related activity.
Additionally, they are not allowed to give treatment advice/suggestions (to speed up any supposed improvement) because they are not a qualified/licensed health practitioner, never mind an expert in our illness, nor a qualified/licensed ‘health coach’ (a more recently available qualification).
