Case Law Engaging face to face PIP was created by Perdita
Has anyone yet received a letter regarding looking again at old PIP Awards due to the Case Law where the meaning of social support was decided which meant some people should have gained 4 points for the Mixing with Others Activity rather than the often given 2 points?
Or is it down to us claimants to chase?

Lots of members have reported going through this, I would have expected everyone to have been contacted by now so I would give the DWP a ring to find out what is happening with your claim.

Thank you. The DWP are just currently in the process of doing my MR for my current review. I am tempted to contact them about the old 2019 Award where I think I should have been assessed with the social support points rather than the 2 points in light of that Case Law. However, I don't want to confuse things , and wonder whether I should wait until they have finalised this current MR. I have never received anything regarding looking again at the 2019 Award due to that Case Law. Have the only just finished, how long ago were the lat ones being relooked at? I would definitely want to do a MR for that should I get a letter saying no change for that 2019 Award despite the Case Law but it would be confusing to have two mandatory reconsiderations going on..... The question is should I get on the case now asap about what is happening regarding the 2019 Award with the change in Case Law in case of time limits? I will be really annoyed if they say a letter was sent out more than thirteen months ago.

I'm sorry but you cannot request an MR for a Decision made in 2019, the absolute limit is 13 months from the date of the Decision.

Your first action has to be your contacting the DWP to find out whether your claim has been looked at in regard to the revised guidance to Assessors and Decision Makers.

If it has not been looked at then why? If the review process is still on-going when will your claim be looked at?

If it has been reviewed, what was the result and when were you allegedly notified. You need this information as there is an opportunity for you to request an MR against this Decision, especially if you can show that you did not receive written notification of the Decision.
