Good morning, my daughter has applied for PIP and it's been refused at the first stage and again following the mandatory reconsideration, with no points awarded at all. I am supporting her with an appeal and so am going through your incredibly useful guides. I have two procedural questions - the first is should she have received a separate medical report from the HP on how she was assessed? All she has received is the initial decision letter and the mandatory reconsideration notice (which is generic and brief). Secondly, your guide to challenging a PIP decision mentions a reconsideration phone call from the decision maker. Shoud this happen in all circumstances as she has not received a phone call from anyone, or does it only happen if the information is unclear? Thank you in advance.
Claimants are allowed to ask the DWP for a copy of the Assessor's Report 48 hrs after the assessment takes place. This is called a PA4. If you didn't have this when your daughter put in for a Mandatory Reconsideration, she would always find it difficult to win, as she didn't know the thinking behind the decision. She can ring for it now - and it normally takes 7 - 10 days to arrive.
The Mandatory Reconsideration phone call doesn't happen for everyone, and I suspect if your daughter got zero points - they decided this was a clear-cut decision. However, it might be interesting for your daughter to ask why a phone call wasn't made and see if they have a 'record' of trying to contact her.
