I’m trying to help an elderly lady as she has had over £200 taken out of her state pension.’
She retired in 1992 and started taking an occ pension.
Last year she got a letter saying her pension credit was overpaid as the law re AIP changed in 2016 and she hadn’t let them know her occ pension had increased slightly.
She had no idea what an AIP was or that the law had changed and is adamant she was not informed! I believe her as she has files and files of paperwork.
She asked for a MR in May last year and heard nothing only to find out in Sept they had already taken the money!
Where to go with this? Any suggestions.

The onus is always on the claimant to notify DWP of any changes to their income from other sources.

I am not sure what you are asking for, does the elderly lady still have an over payment outstanding? Is the overpayment disputed?

If the overpayment is disputed you could ask your local Welfare Rights Organisation for help or even your MP.
