Hello
Hoping to get some advice. I was awarded pip via a tribunal in 2020 after scoring nil points following a f2f assessment. The tribunal awarded me enhanced for both components. I had my review on the 14.2.23 by phone which lasted for 1hr 40mins (I recorded the assessment and a friend was with me to prompt and offer support) I’m now bamboozled as Capita have now contacted me to tell me that they don’t have enough evidence and need to do a re-assessment. I really can’t cope with having to go through that again, especially as I have suicidal ideation and mental health issues as well as physical issues. Has anyone else had to go through this twice? They say they don’t have enough information/evidence but I gave more information this time than I did at my tribunal. If anyone can throw any light on this I would be most grateful.

I'm sorry this has happened to you. I have known a couple of people in the same position as you. It is most unfortunate.
Unfortunately, I think your options are limited.
I would want to know why after an hour and forty minutes, they weren't able to get enough information, along with your form. Was this an error on the part of the assessor, and the assessor has written a poor-quality report? Why can't they ask you a few additional questions - why do you need to go through it all again? If you're up to it, I think you should be asking for a better explanation of what's happened and ask for it from a senior person.
You could tell them you are unable to go through it again because of the 'overwhelming psychological distress' this would cause you and ask them to make a paper-based decision. Unfortunately, they don't have to agree, and even if they do, it's a risk if you haven't sent in sufficient information on your form. If they are already saying they haven't got enough information, a paper-based decision may not go in your favour.
If you flatly refuse, they may say that you didn't properly engage in the process, and that could put your claim at risk.
Another option is to contact your local MP and see if they can intervene. Some MPs have been very helpful in helping their constituents.

Thank you so much for your reply. This action seems particularly cruel and unusual given that I had a panic attack during the assessment and spoke about traumatic events that I usually can’t discuss. Luckily I had a friend with me who did their own recording and will phone up on my behalf. I’ve emailed Welfare Rights about this who think that there may be an issue with interviews going over the hour mark. It’s incredible that the assessor claimed at the end that she had enough information to end the interview. At this moment in time I feel like I just haven’t got it in me to go through it again.

I understand why you don't want to go through it again. Just make sure that when your friend phones, she is with you, so you can give permission for her to speak on your behalf. You don't want them to refuse to talk to her. I really would make her press them to say why they don't have enough information. For them to say, they have to go through the whole thing again, rather than just ask a couple of additional questions, makes me suspect there was an error on the part of the assessor. I also think they will try and argue that because you had a panic attack - they were unable to get sufficient information. You have the recording, and your friend was with you - and she can counter this argument. But if they try and stick with it, she should emphasise that's why they should make a paper-based assessment, and if they require any further information, you would be willing to send a paper response. I'm not saying any of this will work - it's just what I would try in the circumstances.
