From what I have been reading, you have a year after receiving backpay till your benefits are affected. After this year, you can be penalised for capital reduction on unaccepted items, like giving money away in that they will act as though you still have it.
However, if there was a mistake, then your capital is disregarded permanently. Does the original turndown of PIP count as error when it was awarded at Tribunal? I was on DLA when it stopped in 2018. Since 2010 have been on Pension Credit.

It would depend on what the back date payment was for, I would advise you to contact your local Welfare Rights Organisation who will be able to take all your circumstances into consideration to give you an accurate answer. advicelocal.uk

Thanks Gary and sorry, I am finding it hard to take things in at the moment due to ill health. I find the whole issue very confusing but will get back in touch with the man from Welfare Rights, who I must say did not seem very knowledgeable dealing with my tribunal. He also denied that my Atos assessor told lies in my report. He just thought she was incompetent. I am dealing with a large sum of money here, the denial of which over 5 years has negatively affected my health due to not having enough to live in with my health needs.

Not normally, the Tribunal can find that the DWP Decision was an Error but the Tribunal making a different Decision from the DWP is not an Error.
