apply for New style ESA on half pay. SSP used up

. I am on long term sick with the NHS with Long Covid. Just received an SSP1 form. On half pay and will be dismissed in three months on ill health grounds. Can I apply for new style ESA now or do I need to wait? Many thanks, Brenda

You can make an immediate claim for NS ESA, be aware you will need to provide a Fit Note as part of your claim.

My 28 SSP was used up by October 2020 yet my NHS employer only sent me the SSP1 form in January 2023. Is this as I went on to half pay in January 2023 or should they have went this if me in October 2020. If so could I have been claiming ESA. Thanks for your help

You should have been sent the SSP1 as soon as your SSP expired (28 weeks).

Whilst you would have needed the SSP1 as proof that the SSP had been paid you could still have made a claim for ESA starting on the day after your SSP ended and chased your HR for the form.

I'm afraid there is no way to backdate a claim this far back, the maximum allowed in law is three months.
