PIP review query. was created by Sammianne
PIP history.
First applied 2017. Initially denied PIP and took it to appeal. DWP then revised decision and awarded daily living for 2 years.
They did not review that award, they just sent new claim form to complete 6 weeks prior to award end date.
That was late 2019. Standard daily living only for 3 years with end date late 2022, but they wrote to me early 2022 with award extension to June 2023, however sent review form around 6 months ago which I completed and sent back and have been waiting since then.
Tonight early evening I received a txt from Independent Assesment services with what I assume is a standard introduction of who they are etc, but the next part confuses me by the way it is phrased.
They go on to say the txt is for information purposes only and I don't have to do anything regarding the message, but.....it then goes on to say 'we will be managing your assesment'
They then continue to say 'we will look at the available evidence' (does that mean they have ALL the evidence I have ever sent alongside the new review form and additional sent with it, or do they mean literally only what they have available which frankly could be no more than the review form I filled in and no more??
They then say they may contact me if they need to have a consultation with me.
I graphically remember the months of mental torture from my first application, it very nearly ended me, it certainly mentally did damage I still have not got over in the 6 years on.
The first re application when my award was due to end I had in 2019 was okay, mostly because I didn't have the time to ruminate, as I got great help from the Law Centre and from sending form back to assesment was only 3 weeks, and decision just over 2 weeks after that, but this time I've been waiting over half a year, and I was hoping that the review would be done in house by the DWP, but it seems not so.
So, in the txt they sent me they said at the beginning that (please bear with me I have a brain injury and it makes explaining things drag on) that they are managing my assesment, but then later in the txt they said that they will let me know if I need one, so I can't quite get my brain to work out if they are saying that when they say they are managing my assesment does that mean a definite assesment despite them saying later I MAY need an assesment.
I don't know what they mean.
Is the txt they said a purely standard text message when it's passed to them by DWP?
DThe only reason I can think of why it's been passed onto IAS is that despite nothing changing apart from additional evidence such as I now also have a CPN who visits me at home although DWP already aware from last PIP 2019 that I was under the Community mental health team, plus also sent in my full ASD official diagnoses which went into full detail of my difficulties of which they state have been lifelong and compounded by my brain injury.
I also added my temporal lobe epilepsy diagnosis (caused by the damage to the brain cells in my right temporal lobe) but didn't explain anything about that, didn't need to, it's not as yet medicated thankfully and I have not had a partial seizures for over a year, so I just put that down under the conditions lost and date it was diagnosed, so didn't see how it had any bearing apart from it being a diagnosed condition.
I certainly see that aside from the epilepsy diagnosis, a lot of stuff I sent very much bears out a lot of things from my first and second assesments regarding the mobility part which has thus far only scored me 4 points each time, which has led me to wonder due to the court case where they were going through all awards looking to see if should have scored more points on that, if that also could be part of a reason why DWP have sent stuff on to IAS.
I'm tearing my hair out as to anything I may have missed off the form I sent back this time but can't see anything I accidently missed off.
So I am confused and feeling pretty I'll about it despite the fact I've known it was coming and have done since last August.
So is an actual assesment inevitable once DWP have sent it to IAS?
I am really hoping you can make sense of what I have written here.
Please accept my apologies for making this so long and very possibly repeating myself.

Nothing on this board constitutes legal advice - always consult a professional about specific problems
Replied by Gordon on topic PIP review query.

An assessment will be made but that does not mean that they will need to speak to you, they may decide there is sufficient evidence in and with your Review form to carry out a Paper Assessment.
I'm afraid you will have to wait and see what they decide, although you could speak to your GP to see whether they would be willing to write to IAS confirming that any type of assessment requiring your involvement would be detrimental to your health and would cause you "overwhelming psychological distress".
