University, PIP and migration to ADP was created by Margole
Hello. I’d be grateful of some advice/insight regarding the effect on PIP / ADP when someone goes to university please.
Our son currently receives PIP with enhanced rate care and enhanced rate mobility. He is enrolled on a full time degree course and is one year into his studies.
Prior to him starting at Uni my husband (as his appointee) notified the DWP of our son’s impending change of circumstances. The response informed us that his benefit would be reviewed in 2024 I believe. Meantime the payments have stayed the same.
However, we live in Scotland therefore we have heard that our son’s benefit is being automatically migrated to ADP in June and Social Security Scotland will carry out a review in August this year.
My questions are:
1) Is my son’s benefit likely to be affected by the fact that he now lives away from home for 24 weeks of the year in university catered/ensuite halls? He is autistic and suffers from anxiety with OCD traits - neither of which will/have improved by being away from home. Far from it! Do they consider the fact that he’s at home for more time that he’s at Uni during the year?
2) Do you have any idea what the ADP review process will involve or what the questions will be? I understand that there is an option to tick a box to state that nothing has changed, but I’m not sure if going to university is considered a change insofar as benefit entitlement is concerned. Surely not because, if it did, no disabled people on benefits would be allowed to attend university.
3) If he continues to receive enhanced rates for mobility and care after the review, am I right in thinking that the award then becomes indefinite (unless circumstances change of course)?
I realise that ADP is new and not something you are maybe totally clued up on, but I’d be grateful for any response, even if it’s simply a gut feeling or is based on the present PIP rules.

Has your son actually received a letter informing him that he is being migrated to ADP?

Social Security Scotland is supposed to be transferring claimants without an assessment so no form should be required.

His attending university is not a Change of Circumstances unless it is a result of his limitations improving in which case he needs to inform the DWP.

When he is assessed then the process will not be dissimilar to that used for PIP with the exception of the actual assessment where the majority will be done on paper using information from the claimant
and any doctors that they nominate.

The criteria for ADP is currently the same as PIP, the forms are a little more colourful and contain more advice about completing but the questions are the same as the PIP2 and AR1 forms used for PIP.
