Hi all , just read a post on another website where a poster said the DWP when looking at your award and deciding on a review , face to face , paper , phone, they have to take into account your Tribunal award / awards , by proving ( in their opinion ) you have got better ? Or something ? ( in my mums case she cant and wont ever get better ) . This is for ESA .Many thanks x
Sorry for the delay in replying to your post. I confirm what you have read because I haven't seen the post to know the contents.
The DWP can make a decision to review any claimant at any time. If the DWP decide to downgrade someone's award because they believe the claimant's health has improved, they are supposed to explain that decision in a call to the claimant, and offer 'proof'. (This doesn't always happen).
