Hello,
Please can I ask this forum for some advice and guidance as the whole PIP process has been like a battlefield and I feel helpless.
I'm supporting my disabled mom in applying for PIP based on her diagnosis of Functional Neurological Disorder.
I have received a letter from DVLA stating that they have awarded her basic Daily living Component and no Mobility component. They justified this by saying that my mom has previously worked in Greece and is entitled to a pension there, therefore Greece is the competent state to pay her any cash sickness benefits. What I dont understand is that we have explained to DVLA that my mom :
- is a british citizen, not a greek citizen
- she has lived in the UK continuously for 23 years, worked for that amount of time here and contributed to the system
- she doesn't have an address in Greece or Greek citizenship and to Greek authorities she's treated as a tourist. They will not pay her any sickness benefits.
- her pension from the Time she has worked in Greece is a private company pension, not a state pension and their retirement age for women is lower vs the UK.
To me it seems that they dont understand that she's not a european migrant worked, but a citizen with the same rights as someone born in the UK.
Any advice would be appreciated. Should I appeal their decision ?

It can feel like banging your head against a wall at times, I would get your MP involved, it is surprising how quick things move once your MP is involved, some MP's are more proactive than others.
