My sister in law is 78 and suffers with dementia. She has claimed DLA mobility component, not the care component, and this has been extended past her pension age.
My brother uses the motability car to take her for appts etc.
He has been told that she can claim the care component of Attendance allowance and this won't affect her DLA claim.
I am worried that if he goes ahead with this claim, she will lose the mobility allowance of the Dla.
Could you tell me if this is correct that he can claim both as the system has been so muddled these last few years and I know Scotland has a different system to England, and I think that has maybe caused the confusion. They do live in England.
I would be grateful for any advice.

Your sister-in-law cannot claim AA if she is in receipt of DLA, what your sister-in-law needs to do is contact DLA and report a change in circumstances in regards to the care component.
AA is the same as DLA without the mobility component.
Once you reach state pension age, if you receive DLA you can report a change of circumstances for your care needs but your mobility needs cannot be increased if you received either zero award or low mobility. In your sister-in-law's case she is alresdy receiving the high rate mobility so she will not be affected providing she passes the assessment.
When your sister reports a change in circumstances, if she is successful then the award will be backdated to the day she reported a change of circumstances.
I would advise your sister-in-law to seek advice from her local Welfare Rights Organisation; advicelocal.uk
