Hi, I’ve got a few questions re my PIP review via phone, which took place Jan ‘23. I was due my review in 2019, and I did get notification that they were deferring it each year.
I have been receiving DLA/PIP since 2007 and although I have been a member of this site for years, I’ll be honest and say that because I genuinely have avoidance difficulties, and nothing have really changed, I basically ignored reading the site’s updates and all thoughts of the review until the day before. In a panic I recorded the interview without saying to the HP I was doing so, and as you can imagine my PIP was downgraded from enhanced mobility to standard. Again ignoring everything the site has to say, I phoned up DWP ranting like an idiot, and guess what? my mandatory review was the same. Sorry, also didn’t know about PA4?, anyway now I’m going to tribunal.
Question 1, can I use the tape as evidence as to questions reported as un-answered when I have proof I did fully answer them? Remembering they weren’t told I was recording it.
Question 2. I submitted GP and Psychiatrist reports in 2016, should I ask for updated reports?
Question 3. I’m in Scotland and getting confused about where I should be applying to for tribunal as both the UK and the Scottish Gov. seem to have different forms.

In regards to your questions;

1) You may want to get a transcript of the recording which you can use in your appeal.

2) Yes I would ask for updates from your GP and Psychiatrist, if there has been no change in your condition or your condition has deteriorated, I would send in a copy of your previous successful decision.

3) Yes it is confusing, although the forms look different, I am told they contain the same information, as you live in scotland then I would advise you to contact www.cas.org.uk, ~ advicedirect.scot/who-we-are/ or ~ www.mygov.scot/benefits-support
