I am on Universal Credit and my estranged wife is on legacy benefits i.e. ESA Support Group. We both would like me to move back in with her to support and care for her. How would this affect my benefits. Would I need to put her on my Universal Credit?
The key question is whether you would be a couple or more precisely would the DWP see you as a couple?
If the answer is yes, then her legacy ESA would need to be included and she would be added to what will become a joint claim for UC.
If you decide to go ahead and I would recommend you get face to face advice first, do not under any circumstances close the ESA Claim yourself, let the DWP do this when the updated UC claim is accepted.
