PIP Appeal was created by Joan
Hi
I have received a date for my PIP Appeal to be heard in person on 18 July 2023, and would be most grateful if someone can please advise me what the format/structure is for the appeal on the day. For example how many people will sit on the panel to decide the appeal, and how best can I prepare for the hearing, video evidence, personal witness evidence, new medical evidence. Can I take a representative/friend with me and are they allowed to assist me on the day.

I have further medical evidence from my consultant that I will send to the tribunal in advance of the hearing to confirm that I need a second operation on my hand and await a date for surgery. In light of this is it likely that the tribunal may defer the hearing until such time as the outcome is known after the second operation.

I feel really stressed with all of this and I think it would help me if I can better understand the process.

Thank you in advance.

Hi Joan,
PiP appeals will have 3 panel members. Judge, (lawyer), doctor and a disability member. The latter will be someone experienced in care giving eg they might run a care home.
Whilst the exact set up where you are located may be slightly different in my area, we basically have a large room at the back of the courthouse, (separate door to the rest of the court building,) there are 2 long tables one with the panel the other opposite for you to sit at. You can bring a representative or friend/ relative who can speak at the hearing and give evidence on your behalf. Make your you bring the appeal papers as you may need to refer to these.
The hearing us usually like a formal interview, but won't be wigs and gowns and things that you see in court dramas. It should be fairly low key. Wear what is comfortable. If you need to get up and walk, have some sort if break then request this. If you bring someone, get them to write notes. The hearing may well be recorded but notes are useful do you know what has been said.
Remember that as you approach the building and whilst inside you may be seen by the tribunal members who might enter the building at the same time. If you have said you can inkyvwalj 20 metres this will raise suspicion if you are seen walking 300m from the car park!
Consistency is the key. If you can't walk more than 20m get a lift and be dropped off. If you said you wear loose clothes then wear these. Don't dress up smart wear your normal clothes, bring your walking stick etc. No need to wear make up, that's bound to make you look less fatigued and well! Again not necessary portraying the vision of someone who is disabled! Be yourself and be natural!
As for the hand surgery, I don't know how this will affect your overall disabilities. If the hand problem is the only disability albeit affecting various functions then surgery could be seen as a problem, especially if successful would remove the disability. This might therefore be relevant to your entitlement for PIP. If you have several disabilities or health problems and or the hand surgery won't eradicate all disability in the hand, then the surgery shouldn't make any difference.
I hope this helps.
Let us know how you get on.
Good luck.
