I used to be on income related ESA, I have informed the DWP of my change of circumstances (partner moving in). The lady I spoke to said that she would suspend my account and send the new style ESA form out to me so I can continue to get my NI credits. I am unable to work and have been in the support group for 10 years. I know I’m not entitled to the money from contributory ESA, but am I entitled to the NI credits. I didn’t think I was. They sent me such a confusing baffling letter.

I don’t want to fill out a huge form if I’m not entitled to the credits. Any advice would be appreciated.

This is all very confusing but I will try and unravel it.

So, did you have entitlement to Contribution ESA when you made your claim or were you only receiving Income Related ESA?

NI Credits are paid under different legislation from ESA so you don't need to be receiving ESA in order to receive them, you just have to have Limited Capability for Work which you do from being in the Support Group and you retain this until there is a Decision that you do not.

On this basis, I cannot see any reason why you need to apply for New Style ESA, you won't qualify for payment if you have been on legacy ESA for some time, all it will do is confer a right to NI Credits that you already have.

You may receive an ESA3 which captures information about your new financial situation, you do need to complete and return this.
