Are councils allowed to use pip as income on housing and council tax ?

The simple answer is no Local Authorities do not take PIP into account for Housing Benefit claims and the Council Tax Reduction Scheme.

A client of mine is having his Council Tax Support reduce significantly because Leicester City Council is using his PIP entitlement as income and not disregarding it. Is there any source/legislation I can refer to as want to write a complaint letter to them.

PIP is ignored for council tax purposes, it should not be used as income as it is not classed as income, it should give additional premiums depending on their circumstances such as EDP, SDP.
We would advise you to seek help from your local Welfare Rights Organisation, in Leicester you have Community Advice and Law Service (CALS) 0116 242 1120 or Citizen Advice 0300 330 1025
