Hello folks,

If the tribunal decide not to award you, at what point do they tell you this, is it just before the tribunal or sooner?

Hi Bud,
I think the tribunal would have to have the hearing. This might be in person or as a hearing in absence. They can't not have a hearing - this would be a breach the right to a fair trial! At the end of the hearing they might announce the decision or alternatively tell you that the decision will be posted out.

Thanks for that L.

I meant if they decide that you could lose your award? DWP rang me & offered to reinstate my EDL, I accepted. Although I’m still going to the tribunal for mobility. Could they just kick the claim out without the tribunal? Or as DWP pointed out that I could lose my EDL too. Wouldn’t the tribunal inform me of this before the tribunal so I could pull out?

Hi Bud

You are correct, the tribunal should pre-warn you before the hearing so you have the option of withdrawing your claim.

As it is a Tribunal there is always a risk that you can loose what you have been awarded, when you do your submission you can always state that you agree with the DWP to award you the EDL but you disagree with their decision not to award you the Mobility component and then lay out your case with supporting documents.

Hi Bud

It would be at the Tribunal, you are given an option, you then present your case, usually starts off with the doctors asking questions , some time the chair will start followed by the doctor then the third person and lastly DWP presenting officer if they turn up.
