Good Afternoon
My son applied for pip last September 2023 he did not have an assessment until February 2024 and he heard nothing since .He rang them last week to be told he has been turned down .He received no email, phone call or letter telling him this . Do we have grounds to appeal as he has Ankolosing Spondolists and has now developed chrones disease due the the inflammation in his body. The DWP are absolutely disgraceful in their behaviour towards claimant .Any help would be appreciated.Thanking you.
Kindest regards ,
Belinda

Hi Belinda

I am so sorry to hear of the situation your son finds himself in.

1. Ask them to send a copy of the decision letter.

2. Ask them to send a copy of the assessment report - it's called a PA4 - it will take 7 -10 days

3. Read our Guide to PIP Appeals and the guide on how to challenge a medical report - so you can start crafting an answer.

4. Once you have a copy of the assessment report - you will understand why he was turned down. Put in a request for a late mandatory reconsideration. You have up to 13 months to do this from the date on the decision letter (that he didn't receive). You will need to come up with an explanation why he didn't chase this up sooner to find out what had happened. Explain that he didn't understand the system.

5. He could always put in a new application and start the process again. You might want to choose this option as he now has Chron's disease. They will not be able to take any notice of this new development if you put in for a Mandatory Reconsideration - they can only judge on the knowledge they had at the time of the assessment.
