Pip appeal for MM vs Dwp Supreme Court ruling

Hi, I’m looking for some advice. I received a letter on the 16th of October stating that I was not affected by the Supreme Court ruling relating to engaging face to face. The Dwp did not give me any chance to send in medical evidence or any other evidence to prove I was receiving support from mental health professionals. I was told I could appeal this decision through the tribunal. I then started the tribunal process and send in evidence. I contact my local citizens advice for support but they told me they couldn’t help me cause they had never heard of the new court ruling so I am doing this on my own. The DWP where supposed to have responded to me by the 9th December (yesterday) but haven’t. I did contact the tribunal service who advised that it is with a judge to contact the Dwp for a response and that I would receive a letter in due course. I am currently still in receipt of PIP but I am only appealing the about the Supreme Court ruling but I’m wondering will they look at my whole award again? Or just look at the fact to see if I’m affected the the MM vs DWP Supreme Court ruling. Thanks

They will only be looking at the ruling - not your whole award.

Hi just a quick update. Just had a call from DWP today, confirming that they are overturning there judgment about the MM vs Dwp court ruling and they will be moving me from standard rate to enhanced rate now. Thankfully I do not have to go carry on with the tribunal process. I’m so relieved.

Many congratulations on getting them to overturn their decision before the Tribunal. It shows they knew they were going to lose. Well done you, for challenging their previous decision. So pleased for you.
