ESA(c) to NS-ESA without ESA(i) to UC migration?

Just to clarify something David (without wanting to intrude on someone else's topic), in another topic this week you wrote "If the only Benefit you are claiming is Contributions based ESA then you cannot be moved to New Style ESA or UC":-

If I'm receiving both Income & Contribution ESA (Support Group) and I choose not to migrate to UC after receiving the migration letter (because although I'm under the £16k savings limit now, I'm also due to inherit (but haven't yet received) an inheritance in the near future that would push me over the £16k threshold at roughly the same time as migration would be due and it wouldn't be worth the hassle of claiming), obviously I'd lose the Income related ESA anyway, but would the Contribution based ESA still be changed to New Style ESA (without UC) or would it simply remain as Contribution based ESA (without Income ESA)?

I did try and search the forum but I couldn't find a straight answer as to what happens to the ESA(c) bit if you currently get both ESA(c+i) but choose to not migrate to UC and the ESA(i) bit just ends but without being put onto the new UC system. Thanks.

Hi a2012,

The government has not announced any migration of Contributions Based ESA to New Style ESA outside of Managed Migration. So if you ignore the Migration letter and don't claim UC, your Conts based ESA will carry on unaffected.

Hi plampard1st

You will carry on getting the Contributions Based ESA if you ignore the Migration letter.
The DWP are allowed to change it over to New Style ESA but I don't think this is actually happening at the moment. Though there is nothing to worry about as New Style ESA is the same as the old Contributions Based ESA.
The government intend to stop people on the old Contributions Based ESA having a right to claim means tested Income Based ESA which they currently do.
