Nearing pension age UC Migration was created by catherine4859
I will be 66 retirement age first week in August, has anyone any information as to the rules of being migrated over from ESA support group to UC nearing State Pension age. I found 2 articals, one said exceptions if within 3 months of retirement and the second one said within 6 months of retirement. I'm probably just wishful thinking, I just think realistically it would be senseless to claim UC for one or two months then go on my state pension. I asked CAB and they didn't know.

Hello David, I downloaded the

Migration Notice Helpline,
Specialist Teams Guidance.

Move to Universal Credit (Managed Migration) Exclusions and Deferrals. Think its page 8.

Also try, Regulation 44 of the Universal Credit (Transitional Provisions) Regulations 2014.

I have looked at the documents you quote but still cannot find an exemption for those nearing state retirement pension age.
There are special rules for those who have reached state pension age as follows -

Who will not move across to UC?
Some people will not move across to UC and will be invited to claim pension credit instead. However, there will be a small number of people who will not be entitled to universal credit or pension credit and they will not be invited to make claims for either. Tax credit support will be withdrawn on 05.04.2025.

Those who will be invited to claim pension credit rather than UC are:

State pension age claimants who are claiming working tax credit (with or without child tax credit) and who are not claiming pension credit, will be issued with migration notices and invited to claim UC, with some specific rule changes in UC to allow them to claim.
State pension age claimants who are claiming child tax credit and are not entitled to working tax credit and state pension age claimants who are claiming tax credits and also pension credit at the same time, will be issued with tax credits closure notices and, if not already doing so, will be invited to claim pension credit instead of tax credits.
In both scenarios transitional protection will be available . Most mixed age couples will be invited to claim universal credit although those who are protected (which means they are still entitled to claim pension credit) and claiming child tax credit only will be invited to claim pension credit. Similarly those mixed age couples already claiming pension credit alongside tax credits will remain on pension credit.

Hi David,
I just googled Managed Migration guidence February 2024 and one of the links that came up was a charity WhatdotheyKnow' which seems to send a lot of Freedom of Information requests to the DWP.
The heading that came up was updated guidence for teams working on managed migration and I found a pdf titled Move to Universal Credit Managed Migration exclusions and deferrals.
Included in the list was those within 6 months of state pension age.

Apologies its a bit of a long winded explanantion but I am not able to provide the link.
