Discrimination in run on payment ESA to UC Migration question was created by mermaid
I have spent weeks trying to prepare my adult son, who doesn't live near me, and who suffers from severe mental illness and is very vulnerable, for the migration from ESA to UC. I am not his appointee but have spent years supporting him with all his benefits (ESA and PIP) and helping hi to get Direct Payments, as his representative. His finances are very finely balanced. He is not in debt, but he has no money saved, and he has a number of DDs every month.
Just when I thought I had all the info he needed to know, via B & W booklet and asking on other forums about things that no booklet tells you, I discovered via a CPAG (Child Poverty Action Group) newsletter that if you are on Contribution Related ESA AND also qualify for Income Related ESA that you receive considerably less money than a solely IR ESA person in your first payment after assessment (over £200).
I haven't read anything about his on B & W so don't know if people are aware here. It relates to the way they manage the computer programme I guess, subtracting the CR ESA amount each time. I could supply the CPAG link article on this but don't know if I am allowed to.
I have some idea of how much he will get but am trying to work out if he will therefore still get his Severe Disability Premium as I think that comes with his ESA money. If anyone has any experience of this issue, or knows this, please let me know, as he is worried already about managing his money, and this issue which I now wish I had told him later on, has thrown him. He is midway into the process and is due to sort out his identity hopefully next Wed at the Jobcentre.

Hi mermaid,
Thank you for your post - and hopefully your advice will help others who are experiencing a similar situation to yourself and your son.
As for the SDP - I have heard Martin Lewis talk about this on one of his shows, and how it entitles you to free Council Tax I believe (but don't quote me on that, as I may not be totally accurate). I've enclosed a link though, that may be of some benefit to you to read:

Thanks Chris. I don't think SDP qualifies you for free Council Tax, though previously my son did get his CT reduced to nothing. Individual Councils can make their own rules on this, so it's possible that his Council did take his various disability benefits into consideration in their decision, but that may also be because of his low income, and that he is on highest level of PIP Daily Living.
I am going to put the link to the article I mentioned above so please delete if not allowed. It's re the issue I highlighted for people migrating to UC who are on both ESA Contributions based, AND ESA Income based. It revolves around the issue of discrimination in the first payment (only) at the end of the Assessment period between those who are ESA Income based only who get more money (by around £300 I believe) than those who are ESA NI contribution based, but ALSO qualify for Income Based ESA.

Hi mermaid,
This is what I meant (zero award/free). PIP isn't means tested, so although the local authority can ask for this information if you're on benefits, then I don't believe PIP comes into place with this, however I'm not 100% certain if this is the case or not.
You are allowed to publish articles if they are of benefit to our other claimants, maybe to read for advice, or a petition to sign for example.
I hope this helps answer your question, but if you're still unsure - then there's a brilliant website that is of some use to help with working our your benefit entitlement.
