Thanks Steve, really appreciate your advice, fingers crossed that the ESA medical outcome will be positive next month. If so, I will certainly use it as evidence as you suggest.

They have made a decision on my appeal and there has been no change
Am now waiting on a hearing

Hi paul,
It really is quite rare for the decision to be changed prior to a hearing, I'm afraid.
The fact that they haven't changed their mind is no reflection on the possible strength of your case, but only on the very low standard of decision making and the lack of staff time to look again properly at cases before sending them off for appeal.

Its now April and I have not heard nothing about a Triburnal date, They seem to think it will happen in June?
Have had some good news from the Community Legal Advise team, They have got a decent letter to back up my mental health from my CPN amd now waiting on my Doctors letter
Why is it that they are trying to stop our benefits but not stopping the support services I receive as part of my housing care package?
Have even thought about killing myself/Stop tasking my medications but my consultant had advised me that I can live up to 2 years without them
Have never ever gone through anything like this before and I never wish to go through it again
Have no idea who I am even going to be voting for this year, Thats if I can even be bother to vote

It has been months now and I have my hearing set for the 17/09/2010
My first hearing was going to be on the 20/08/2010 but they stopped it after they received the submissions papers and put it back another month
All this has made me very ill and the stress
Will be glad when it all over and done with and I never want to go through this again
Was glad to have a legal case worker to sort it all out, No way I could of done it on my own

I only found this site a couple of days ago after looking around for advice about the forthcoming dreaded tribunal. I like many others on this site have suffered undue stress and exacerbation of ill-health due to this ridiculously unfair process but remain determined to fight.
I am already in a mad panic about the hearing in 5 days time but just wanted to wish you all the best for the 17th and hope we both receive a favourable outcome.
