Wrongly migrated to UC Housing Element

My family member who has a severe learning disability has lived in a self-contained housing association small block of flats exclusively for people with learning or physical disabilities for over 10 years. The property was commissioned by the council in collaboration with the housing association many years ago. To live in the block tenants are nominated by a social services who also arrange the support.

When my family member migrated from legacy benefits to UC, they lost HB but according to the DWP regulations they live in specified accommodation: managed property. UC  impacts on transitional protection and my family member falls into the group of people who should be protected from the impact of welfare reforms on his income via HB due to their support and accommodation type. The council has always referred to the development as supported living bur disputes HB is applicable. Anyone in a similar situation?

Hi, have contacted the council & housing association again. It appears the supported living project comes under a Managed properties:
Landlord type
Housing association, charity or voluntary organisation
Care, support or supervision
Provided by anyone and not necessarily by or on behalf of the landlord

The supported housing was set up nearly 20 years ago in collaboration with the HA and council under supporting.people. The council even won an award for supported living and housing The council and HA seem to have lost all records. The onus now is on us to provide all the evidence but they should have it because they placed my family member there. It seems a number of people migrated locally to UC instead of remaining on HB. Going to see an advocacy service today. Thanks
