Time limit on IB50 and Tribunal letter

Hi,

I'm hoping that someone out there can help with these 2 queries.

Firstly, I had IB stopped in Feb 2008, disallowed on appeal and then reinstated after consideration by the Tribunal. The Tribunal letter gave no end date. Does that mean that the IB is reinstated for an indefinite period, or does it just assume 12 months?

Secondly, I've received an IB50 today, stating that it has to be returned by 17th May. Is such a short period normal? or should it be 6 weeks? As I live abroad, this could be a little difficult to manage.

Hi,

In effect IB awards are indefinite, it's just that the DWP checks your continuing eligibility at periods which usually match the period suggested by the health professional who examined you, if you had a medical.

So, if the health professional said that you should be re-referred in 12 months then that is when you are likely to receive your next IB50 questionnaire, regardless of whether or not you got your award due to an appeal.

The period allowed for returning a questionnaire is set out in the IB guides in the members area and there hasn't been any change to that.
