Hi sorry i did go to reply but the site was down and i have spent last few days in bed with the stress of it all i got there and they adjorned until a future date as they had not received a complete copy of my file (letters - only 1 side copied etc) and they didnt feel they had enough time to go through my case properly, all i could do was cry they were very nice though and said they would take the additional information i had received the day before from my nhs occuptional health ot which states i am unfit for any kind of employment in my current condition, so i am STILL waiting lol

Still not heard about a new date for tribunal knowing my luck i will be waiting another yr lol.
I am now officially unemployed as of today after being dismissed from the nhs am i able to sign on whilst waiting for tribunal although im unfit for work? x

Have you considered appealing the decision to dismiss you? I don't know the policy/procedure in the nhs re dismissal on health grounds but in local govt if all reasonable adjustments have been considered & will not make it possible for you to continue working then the employer has to consider ill health retirement. My employer dismissed me(I have CFS/ME)& I have lodged an internal appeal for unfair dismissal & a claim with the employment tribunal as my employer didn't follow its own policy & procedures & was in breach of the DDA & the ACAS code of practice. Under the LGPS it is also possible to apply for consideration for ill health pension months after having been dismissed May be worth looking into.
