Hi
I was wondering if I may ask. I recently had a PCA medical which I passed. I requested a copy of the doctors report and score sheet. I received the doctors report(no score sheet) from the DWP and I'm furious to read that he disagreed (it states on the report 'agree's, disagree's' with claimants statement)with all but one of my statements. Meaning I only qualified on one descriptor.(15 points )
I know this to be common practice now that these doctors are simply writing what they want.
The thing I'm now worried about is that my DLA is up for review later this year. Will this medical be used during the review of my DLA ?
Most of what the doctor put was fabricated, but because I passed PCA do I have any right to argue that this medical was complete tosh, or do I just sit and wait and see ?
Any thoughts would be appreciated.

As far as I'm aware the PCA medical and the DLA medical are two separate entities although there are instances where the results of IB/ESA medicals have been used to determine DLA decisions. However as you've passed the PCA medical I would suggest that that result will have little or no baring on the result of your DLA review.

Hi all. I just want to confirm that I'm the forum member in question who's had their DLA stopped on the grounds of failing an ESA Atos medical over 8 months prior to an ESA Appeal Tribunal.

Just to update, I'm waiting for the Statement of Reason for ESA appeal decision.

I have this week had a letter from DLA saying they are reconsidering my claim due to my letter to them and it may take (the usual) 11 weeks for their decision. I will appeal if it dosnt go in my favour. I am expecting to have to do this.

Ironically, I have now had the operation I was awaiting (reason for being on ESA and sick notes covering me for) and have been continuing on ESA with no breaks !!! Jobcentreplus agreed with me that it was not appropriate for me to sign onto JSA.

I will, of course update here when anything happens.

Hi 1smallpole,

When I sent a recent DLA renewal, I amended the consent page so that the DM was unable to obtain any medical evidence from any other source other than the ones I had included on my DLA form.

I have to say I did have my doubts about doing this but in the end I decided that why should I give permission so that other medical evidence could be used especially when the last EMP report was filled with inaccuracies.

I am really glad I did this in the end, not only was my HRM given, but my care rate was increased to MRC, and no EMP visit. And to tell you the truth, when I got my letter confirming award, the DM had written "information used, your claim pack and your GP factual report. Now isnt that how it should be, ie the 2 people who know best.

Well done Kathy, that was a brave decision. It gives us food for thought, why should we agree to something that we know will have a negative impact towards our claim for DLA.In my own case the EMP didn't turn up on both occassions and similar to yours the award was made without them, however I dropped from HRC to nothing on the strength of it, so it is a gamble, but still worth it..I am glad it worked out.. Brilliant

Thank you Gareth, Kathy for your responses to my query. When I read my report I actually had to check the front page for my details as I thought I must have someone else's, it was so full of tosh !
I certainly wouldn't want that used in future.
I just wonder why they actually bother asking you to fill in forms and attend medicals if they are going to write clap-trap anyway.
