Appealing an ESA decision and starting work

Hi All,

Wondering if you can help. Since, on receipt of an ESA appeal, your claim is effectively divided into two periods (please correct me if I'm wrong, I'm kinda new to this side of things) - pre appeal/decision date, and post, how would starting work affect the appeal? Can it still go forward if you are no longer claiming ESA (assessment rate), or JSA, and have actually started work?

Hi maibai,

Your award would come to an end if you started work, unless it is permitted work. But your appeal would still be valid and would relate to the period up until your claim ended.

Good luck,

Steve
