I am scared of losing what i have got!!!

Hi all

Thanks to Jim1 for pointing out that Steve (moderator) has included a case on claiming high rate mobility for incontinence CDLA/0217/2009. If only i had seen this before i completed my renewal for DLA. I have severe Crohn's disease and suffer with incontinance which is quite troublesome. I sent in my DLA renewal in May and they increased my award to high rate care but said i wasnt entitled to mobility at all. I am over the month for appealing (just) and i am so scared of losing what i already get!!! Has anyone any suggestions as to whether it is worth me risking it, any help or advice would be greatly appreciated. The dated letter for my DLA renewal was 19/6/10 if that is any help.

You could request that your appeal is admitted as a late appeal, but you will need to show good reason (extenuating circumstances), why you did not appeal within the prescribed time limit. If you decide on this option, your reasons for appealing late will be considered by a legally qualified panel member (LQPM), who will decide if the appeal can proceed?

Alternatively, you can simply reapply for the mobility component taking into account the associated risks, as detailed in the FAQ's section of the forum.

Hi julie steve put the case in the members News section as soon as it was received. It is worth taking a daily look at just in case. Sorry i couldnt of onformed you sooner. But CDas always has given excellant advice, Best Wishes

I guess under the circumstances it may be best to leave things be rather than risk losing everything and especially since i have been awarded this for 5years!!! But i will be better armed in 5 years time. It does state on my decision if the mobility side changes to contact them, but i guess it says that on all letters. They really do get away with things purely relying on applicants not knowing the law. I really hope this site goes on forever without it who knows where we would be. Thank you for getting back so quickly.

Hi Jeff1

I only joined the site this year and it has taken me this long to study as much as i can in great depth and i am still finding something new everyday!!! I think for the first few months i became that involved in renewing DLA and starting ESA that i have obviously scanned over important points so its my own negligance that i missed it and i am grateful that you pointed it out when you did so thank you! Maybe my mistake may help somebody else and if thats the case then it makes it all worth while. In 5 years time when my DLA HRC comes up for renewal mark my words i will be ready!!!! Its such a comfort to know that there are a lot of folk like yourself and all the moderators on this site that are there willing to help and advise - to me that is valuable!! Once again thank you!!
