A short while I was awarded DLA (both components at highest rate) indefinately. After reading about the introduction of PIP am I to assume that my award wasn't worth the paper it was printed on? :angry:

For "indefinite" read - "We haven't set a date for reassessing you, but we could do a spot check at any time and in 2014 or thereabouts (subject to new legislation) the government is going to get rid of DLA and you may or may not get anything at all then."

I always thought that you could not make any legislation retrospective. Surely their must be something regarding the term indefinate or lifetime award which gives the legal defination of the term used at the time.

It's probably a term, adopted by the powers that be to shut people up as it sounds like 'forever'

when infact it means an undefined time, a non specified time ie

whenever they want to reassess you they can and will.

It wouldn't be retrospective because they wouldn't be taking away monies already paid.

Also even if they decided not to remove an indefinite reward, there'd be nothing to stop a government reducing the rates to zero, so you had an indefinite award of nothing. There's generally a legal way of doing most things the government wants to do.

Nothing is written in stone as yet with regards to DLA re-assessment, we will just have to wait and see. (que Sera Sera) ;)
