IB/ESA Migration - called long before review date?

Hi everyone
I have been receiving IB for many years.
Last PCA in January. Review date set by DWP at January 2014.
Received ESA pack in April - yep around 10 weeks later.
HAve been arguing with DWP since then - they say that even though their published literature says claimants will be called at their normal PCA review date, they can call you any time, and then you have to go through the process, regardless.

Question is - anyone else in this position?
Anyone had any success in challenging the DWP o being called in early?

They state that IB will continue "as long as I remain entitled to it". Well surely if their own review date was in 2014, I will remain entitled until then?
Has anyone had their benefit stopped as a result of ESA migration process?
Thanks!

Hi Miss Pink

I'm afraid a review date in 2014 does not give you an entitlement to this date; it's merely the date that you were due to be reassessed. The DWP can argue that failing the WCA entitles them to supersede the original decision.

I understand that the DWP's timetable for IB to ESA transfers is provisional and subject to change to control the work flow.

Best of luck for a successful transfer.

Derek
