Is the supporting evidence from your doctor for the appeal looked at in the reconsideration process.
Would the appeal tribunal have the support evidence passed on from the person reconsidering and have and have that persons thoughts to hand and may be influenced by their decision?.
Do you take supporting evidence to the tribunal or is this submitted before hand.
Sorry for all the questions is just that i cant concentrate and take in 30 odd page documents. I find it very hard to achieve that kind of concentration and memory retention.

There are many who believe they are shunting a lot who clearly should be in the support group into Wrag without a medical then seeing how many appeal. Of course a lot don't or didn't know that their money would stop after 12 months if this is approved by The House Of Lords [going through now with some fighting against the time limit] the soonest it could be law would be april 2012. So many left it to late to appeal.
I sent in my appeal form the end of august, received by them the 2nd sept and I am still waiting to hear back from them... going a bit more insane every day.

no I havent passed a medical they have just phoned this morning saying i have been placed in the wrag group no medical is required.
Also confirmed im a contribution based claimant.
So you recommend getting the appeal form GL24 sent in before a CAB appointment.
I was wondering if I would be better time permitting to get an experts view on how to fill the form in and organise a appeal on that basis.

Hi A,
It would be prudent to send any supportive evidence to your appeal with your GL24 Form.
However, do not delay in sending your GL24 form within the month deadline given.
Any supportive evidence should be sent to the ESA Decision Maker, as soon as you have it.
A different ESA DM will automatically carry out a review/reconsideration of your case file.
This reconsideration can take up to 11 weeks, however it can take much less than this.
If the adverse decision is not changed at this reconsideration stage, then your appeal will be sent forward to the Tribunals Service.
Some time after this you should receive a "bundle" from the DM containing all the evidence that has been used to review your decision.
You can submit further evidence to the TS right up until the date of the appeals hearing.

I know its a shock... I cried for days I was bewildered confused and terrified... then I got mad
read a little at a time...
we'd have to sell our house too... we barely get by now and I doubt I could survive what it would do to my already wrecked body and mind but I know I should be in the support group on at least 4 descriptors.
sorry, my concentration is drifting... fog getting thick
