Absolutely same boat as you biffer. Descriptors plus eceptional circumstances. Should have passed on both.

ESA85A when do you recieve this?, is it one of the requests you can make or does it come with the bundle.

Welcome to my boat, and God preserve all who sail in her. ;0)

With regard to ESA85A: what I've learned from here is that this is the report which Atos produce, based on your completed ESA50 questionnaire, and without a face-to-face medical. I've just written to my local JC+ to ask for a copy of it, though some posters have said it contains little of use to our appeals.

In the same letter I asked for copies of all relevant paperwork. I also asked, politely, if this could be done a.s.a.p. as my completed GL24 appeals form has to be in within 3-weeks now.

Whether any/all paperwork will arrive in time to be useful for the GL24 'hurdle' only time will tell. However, it's important to get the GL24 posted off within the deadline, irrespective of any information you're waiting on from your local JC+.

Right a update on my Appeal with the CAB taking over the process for me.

Fairly long telephone conversation end of last week, their approach is to get the appeal form in more or less immediatly, and at this very 1st stage just basic and short reason as to why Im appealing.

Looks like they arent that bothered with the 2nd decision maker they want the bundle returned so that they have some 'MEAT' to go on in order to put forward a concrete tribunal case.

my representative did warn that they have found it exceptionally difficult to overturn wrag to support appeals and in fact have found that sometimes you can have your money down graded or taken away!!.

When the bundle is returned she said she would advise wether it is worth going ahead with the tribunal, so I must admit I felt really deflated after the phone call.

I was pointing out the 1 year rule for CB ESA and she said yes it was unfortunate but she had had a lot of other cases.

Looks to me like Ive got 1 year now to try and cut down all my outgoings and to get my house ready for market sale or try to get back to work but that would be asking for a miracle given my health.

Oh gosh i really feel for you & am quite depressed now after reading your post.
i must admit, i have been trying to go to bed early & get up early to try & get my body into a routine with a view im going to have to get used to it when im forced to find work.
not that there are any jobs out there, & not that anyone would employ me anyway with my problems, & being bipolar & manic i either normally sleep for 21hrs or am awake for 40hrs.
oh this is terrible :(

Hope I havent upset you too much it wasnt meant to.

I suppose they at CAB are the experts the pros and do this work on a daily basis and are just pre warning and not expecting us to get our hopes too much just in case we do have failure in the end.

It goes to show how complicated this whole process is and made worse by the fact that we are unwell.

I don't think my GL24 and letter were very impressive and with no accompanying info from my doc (practice policy), it maybe didn't back up my appeal request. I am going to have to rely on the descriptors, I believe approx 4 were definite 'no's' on the ESA50 and the exceptional circumstances rule and any support from CAB.

I am still trying to find on this site, which I just can't track down, but read them a couple of weeks ago:

a) The break-down list of disabilities/conditions and the stats breakdown of those in SG, WRAG and JSA and

b) The detailed piece describing going to work '9-5, five days per week' and if this was to have a detrimental affect on physical/mental health.
