The reference in question was to those who failed the means test AND had not re-qualified for ESA(CB).

If you initially fail the means test and subsequently, due a reasonable change of circumstances, then meet the requirements of the means test, you can apply for ESA(IR), it is not clear at this time, whether the linking rules would apply or whether this would be considered a new claim.
