Days spent in the Support Group do not count towards the 365 day time limit.My understanding is that the Support Group overrides contribution based 12 months ESA. If you qaulify for the SG there is no 12 mon th limit, and even if you are a millionnare, you'd still be paid
That is the reason why the Support Group will be the much wanted allocation for migratees and new claims.

As long as we get in the support group before the 365 day rule becomes law in April. If we are in WRAG, appeal to get in support group and the appeal is not resolved before April, we will not get paid?

The relevance of 6 April 2012 is only to those, who on that date, have already spent more than a total of 365 days in the WRAG, for anybody else the relevant date will be based on your ESA claim date, or your Effective date of transfer, if you have been moved from another benefit to ESA.

Don't forget that anyone who appeals WRAG to SG and is successfully given SG status on appeal, the revised Tribunal award of SG would be backdated to the original date of the appealed WRAG award.

However, with regard to your quesion, yes, he did state that there are circumstances where a claimant who has already spent 365 days in the WRAG, who was not eligible for ESA(IR) due to the means test, would still be unable to claim ESA(CB), even if they now qualified for the Support Group.
Surely this means they could be in the Support group but not be paid?
