The appeal form

Hi all. I have just been given an appeal leaflet from the JSA. (It has no ID number apart from 2010 DWP) but it explains the appeal process etc. At the back it has a small box for writing your reasons why you don't agree with the decision. I assume even this has to get past someone's decision process and be accepted or not.

The Doctor has signed me off for two months with a sick note. The JSA say it's as good as irrelevant! I still have to show that I'm available and able to work to recieve JSA and Housing Ben. So by their own admission and reading between the lines, anyone on the sick note IS NOT able and ready to work and should not be 'signing on'. No choice though as we all need that continuation of funds to live, or be made homeless.

Anyway I can find no advice on dodging bullets on this obscure leaflet. It must be important though as it reaches the 1st Tier tribunal of the appeal people.

If you are appealing a decision, the leaflet you needs is the 'If you think our decision is wrong' leaflet, called a GL24.

You can download one to compare it with the form you have from here:

Re completing it, you only need put the brief circumstances in the boxes if you are contemplating sending in further evidence (but do say so), or you can attach further information and evidence on continuation sheets attached ot the GL24 (Put your name, national insurance number on every page and if possible number them as 1 of x, 2 of x, 3 of x etc (where x is the total amount of pages attached).

Just a query though, if you are sick, ill or disabled why are you claiming JSA, as ESA could possibly be more appropriate?

The form that you mention re : appealing should be a GL24, one can be downloaded from the "Appeals" section in the FAQ's.

You only have 1 month from the date of the adverse ESA decision to submit an appeal.

If you do this, and provide the DWP with "fit notes" from your G.P., then you should receive assessment rate ESA whilst appealing.

On appealing, your ESA claim will receive an automatic reconsideration from a different DWP Decision Maker, if the decision is not changed at that stage, it is sent forward to the Tribunal Appeals Service.

The JSA didn't give me a GL24 but I suppose I could DL it, then send it to a friend to print off. No printer here.

My 30 days are more than likely up, but I was actually told by the DWP, "not to bother appealing as I don't have the points"!

That has delayed things. Cheeky gits eh

Check the number on the leaflet you've got. From your description, it sounds very like a GL24. Yes, the appeal form does have a very small space on it for giving your reasons.

However if it isn't labelled GL24, if you or a friend is able to get to a Jobcentre, you can pick one up there.

Bearing in mind the information you say you were given by the DWP, it may (and I emphasise the may) be possible the DWP would accept a late appeal if you are already out of time.

Hopefully you will have the details of the DWP person who told you 'not to bother appealing' and time/date of phone call etc which should be supplied to the DWP with your appeal documentation.
