ESA decision? was created by Condor
Hi All, apologies if these questions have already been asked but as I couldn't find answers to my questions I have to ask so here goes.I filled out and submited an ESA50 form mid October 2011(I was on IB long term) and have been nervously waiting to see where I will be placed, well today I received two letters one containing my P45 parts 1A part2 and part3 with no letter explaining why,is the P45 and ESA311 related? In the other envelope I received an ESA311 Entitled "About your benefit" and "Possible changes to your ESA" further down the page it says "We're writing to you because, if the change becomes law ,it could effect your benefit. You currently get contribution based ESA and you're in the work related activity group". My questions are,Q1 is this a decision letter telling me I'm in the WRAG? (if it is it's a very poor letter and not very clear at all), I've not had any contact from the DWP since submitting my ESA50,Q2 should I have had or will I have a phone call from DWP now? Q3 If this pathetic letter does mean I'm on WRAG how long do I get to appeal, how do I appeal and what happens once I've sent an appeal letter to DWP?.

How I'm supposed to be fit for work is beyond me, if I have to attend work-based interviews or the like I don't know how I'm supposed to get there as my car is off the road due to lack of funds, I live in a rural area with no buses, even if there were I wouldn't be able to use them due to my health, I find it very difficult to travel in my friends big 4x4 with heated seats and high ride height, I need someone with me when I travel even locally,so if this is a decision telling me I'm in WRAG group it is absolutely ridiculous!
Thank you in advance Condor. ;) :(

It never ceases to amaze me that the DWP seem to be able to deliver bad news by next day delivery and yet good news often takes weeks :(

The P45 indicates that your IB claim has been closed, you should retain it for tax purposes, but do not need to do anything with it regarding the DWP.

The ESA311 letter, is a standard letter being sent all Contribution Based ESA claimants.

The good news is that you are in the WRAG and have passed the ESA assessment. Claimants often confuse the WRAG with having to work, but this is not the case, although you will be required to partake in Work Related Activity and may be referred to the Work programme.

See the following FAQ.

If you believe you should be in the Support Group then you can appeal the Decision. See the following FAQs

Hi All and seasons greetings, I'm not sure what to do now, should I appeal re being placed in the WRAG in the hope of getting put into the support group? if I did would I have to go to Tribunal? or a medical perhaps or both? I'm feeling somewhat exhausted now after just preparing for and attending a tribunal for DLA,your comments appreciated...best wishes Condor. :)

Yep, got a brown envelope this morning and thought my confirmation letter of their changing me from WRAG to SG has arrived, sadly it was not. It was a P45. Had to laugh as I haven't had one of those for years, was a tad worried and rang them up but after reading up on here I find I don't need to worry. I would like to echo what others have said that the DWP send things like this quickly but my confirmation letter still has not arrived. I don't know what my new rate will be etc. The lady I spoke to at DWP this morning said to give it two weeks and if I've not heard to call again (2 weeks is up at the end of this week) and they'll send it out.

Seasons Greetings to everyone :-)
