DLA Tribunal

DLA was turned down without GP's report. I now have a new consultant's report, which doesn't reflect day-to day symptoms. I've a rare auto-immune disease which has taken 5 years to diagnose. I am going to ask my GP to send a report to the Court as he has seen my day-to-day problems & knows me well. How much notice will the tribunal take of his report or should I try and get another Consultants letter?
Anything else I need to do? Scared stiff!
Thanks, Angela

I've got my DLA tribunal date for January, so only a few weeks to get evidence to the court. (Xmas in between!)

Hi Angela
Any evidence you wish to submit should be sent in advance. As long as its supportive and relevant the tribunal should take it into account.
Attending yourself, (oral appeal) will give you the opportunity to fully explain your needs. Please note that its the needs arising, the help needed from someone else and not the medical condition alone that may lead to an award of a component of DLA.

How to submit an appeal
Is there any risk to challenging a decision?

I'm afraid there is no way to know how much weight a Tribunal panel will place in a piece of evidence.
As the report was produced after the original Decision, it is important that it is clear that its contents apply to that that date and relate to limitations that you had at the time of the Decision.
You should aim to have all of your evidence submitted to the Tribunal Service, ten working days before your hearing to ensure that it is circulated to all parties.

Information is helpful. Thank you. I will make sure the report relates to prior to the decision.
