No, you can't request it, but you can word your entries on the ESA50 to show that you meet the Support Group criteria.

So if I say I wish to refer to section 35(2)(a)(b) of Employment and Support Allowance Regulations do you think this would be ok to draw their attention to it?

You can, but in all cases where a claimant is trying to invoke the Special Circumstances rules, the burden on proof lies with the claimant.

So it is not enough to just refer to them, so you need to show that you meet them and provide evidence to confirm this.

Thank you for that Gordon. Can I also ask what number this regulation is and is there a link to all the regulations?

(a ) you are suffering from a severe life threatening disease in relation to which:

(i) there is medical evidence that the disease is uncontrollable, or uncontrolled, by a recognised therapeutic procedure, and
(ii) in the case of a disease that is uncontrolled, there is reasonable cause for it not to be controlled by a recognised theraputic procedure.

For the support group it is Regulation 35 et seq, and for the WRAG it is Regulation 29 et seq which is part of The Employment and Support Allowance Regulations 2008.
