DLA

Can anyone advise me please, i suffer with ME/CFS and other health issues. I was awarded the lowest rate of mobility 2 years ago and it came up for renewal. My support worker who deals with the benefits, came to my home and filled the form in and we were quite thorough with the form and sent it off.

I had a letter yesterday, stating i am still now on the lowest rate of mobility and also awarded the lower rate of care. My worker advised me i should be on the higher rate!

How does one go about appealing and can i appeal and what are the difference of the rates? I am also not being awarded the care until February next year?

If you want to appeal you should follow the B&W link here -

You should appeal on form GL24, which will lead to a reconsideration, in the first instance. If unchanged you can go to appeal.

DLA is based on the care you need from someone else (needs arising) and not soley on medical condition(s). You do not have to actually get that help however, to qualify.

May I just advise that there is a possibilty that challenging an award, could lead to your present (lower rate) award being being lost altogther.

Is there any risk to challenging a decision?

Thank you Michael, it is all so confusing. But i have looked at the higher rate and i would not qualify as although my daughter is here at night,she does not look after me. However, the middle rate one, i do find it awkward to communicate and i tend to ignore the phone and try and get our of situations as i do not feel comfortable of which also stresses me greatly. So not sure. But the lowest rate of care, this said to cook a meal for one. I have a daughter, so how does she have a cooked meal?

As Michael pointed out, you don't have to RECEIVE any Care, just demonstrate your NEED for Care. I get High Rate Care and I live alone!
