HARMUL INFORMATION NOT TO BE COPIED TO CLAIMANT was created by Ros1e
hello all I'm new to the forum so please bear with me. I have my IB appeal coming up in a couple of weeks, and in the appeals papers I have just noticed that on the back of the medical assessment conducted by ATOS it says "HARMFUL INFORMATION NOT TO BE COPIED TO CLAIMANT"... what does this mean? And are they allowed to withhold information from me? Any advice much appreciated. Thanks in advance

An example of the sort of scenario I think it refers to would be where your doctor thinks you only have a short while to live but hasn't discussed it with you yet, or where you have a mental condition but have no insight into your problems and your psychiatrist needs time to gain your trust before discussing it with you more or where it would cause unnecessary distress because you couldn't make sense of the information anyway.

There are some circumstances where a doctor may decide that information in your records, might cause cause you harm if you were aware of it, this is referred to as harmful information.
This does not mean that the information is harmful, but it might be.
You may still be able to gain access to this information by raising a Subject Access Request, however, access has to be authorised a an appropriate health care professional, so your request may still be denied.

many thanks for your reply, if either of the above points were true in my case then they should have found me unfit for work, which they didn;t... so I have to assume it's something else. Thankyou for your informative reply, very helpful
