ESA support group and DLA renewal

ESA support group and DLA renewal was created by harley
I was recently placed in the ESA support group without a medical, after transferring from IB.
In December I sent my renewal form off for my DLA, which I have had for a number of years, I have always had LRM and LRC, over the last year my care needs have increased considerably, DLA have now sent me my result and it is still LRM and LRC, but it is now an indefinite award. This I believe is because I have now been diagnosed with COPD.
I am thinking of appealing, does anyone have any advice. I do realise that if I do appeal, I risk losing my award alltogether

Harley, This really goes to show how every case is different I guess. I have had Higher Rate Mobility and Middle rate Care for some years now yet made only the WRAG ( without a medical)...Only thing I can suggest is go over what youve written in your submissions for ESA and DLA and make sure there is nothing there that could be classed as a discrepancy or that seems to contradict the effects of your particular condition.
Even if people give a truthful account of their issues, ( which I am sure most do) sometimes errors made in the wording can be picked out and used in a negative way by the DM or ATOS... It is really important to give clear and detailed info.

There are only a few areas of overlap between DLA and ESA, primarily in the areas of mobility and continence, so If your Support Group award was not due to these, it is unlikely that it would have any effect on your DLA claim.
I would also say, that while we have evidence that failed ESA claims are notified to the DLA unit, I could not say the same for a successful one.
There is always a risk, see
Is there any risk to challenging a decision?
You don't say whether you think your Care, Mobility, or both have increased? Did you use our guides for your renewal?
Is it possible, as you have had your LRC/LRM award for some time and I assume more than renewal, that you approached your renewal in a similar manner to previously and as a result have not clearly identified your additional needs on the form?

Hi Gordon, thank you very much for your reply, yes I have had my LRM and LRC since 2001, but my conditions have changed a lot since then, I have short bowel syndrome, and an illeostomy, and I am on total parenteral nutrition, I have a hickman line in my SVC, and have 3 litres of fluid everyday over 14 hrs, and now I have COPD. When reading the reasons for my DLA award in the letter, it only mentions that I need about an hours care during the day, that's a laugh.
I clearly stated in both my ESA and DLA forms about my care needs during the night.
Do you think I should ring the DLA up? and ask to speak to the DM who made the award, or is that not possible.

You can try and contact the DM, it will require a call back as the call centre will not pass you through to them directly.
