Hi, I apologise if this has already been answered elsewhere. I have done my best to look.

My Daughter aged nearly 21 previously received High Rate Care,High Rate Mobility of DLA for approx 4 years. She is no better, yet when she filled in Renewal Claim in May last year it was refused. (We followed all advice here and I have some experience in Benefits Claims).As part of having it looked at again a Doctor examined her at home.

My Daughter has a lot of trouble accepting her physical limitations as she has had problems for so many years, really since she was little so it seems normal to her. Consequently she underestimates her difficulties..

Also some of her physical problems cause cognitive and memory problems and she becomes very fatigued.Consequently I am usually with her when she has a Medical appointment.

(Sorry this is long, just trying to explain)
When the Examining Doctor called he was okay and it seemed to go alright . However, I had to leave the room due to domestic emergency, (kitchen flood).
He continued his questions in my absence.
I was not unduly worried as I thought from previous experience that the answers she gave would either be read back or we would be given them to look at at the end.
At one stage when he had seen her identification he asked her to sign, saying it was just to confirm her identity. Then he left , giving us no chance to check anything.
Because we were concerned we faxed the DLA Unit expressing our concerns that we had been unable to check the answers he wrote were accurate. (I have seen previous examples where Doctors get it horribly wrong, and to be fair my Daughter is not the easiest person to understand.)

Anyway she has been refused again. I raised the query with the DLA Unit as to whether she should have been able to check her answers and what she had actually signed. They told me they didn't know. They are sending me out the Doctors Report but meanwhile I would just like to know if anyone can answer me. It seems nonsense not to be able to check the replies, and I think her signature may have been to say she agreed they were accurate. Is it possible the Examination answers have been invalidated if procedure not followed?

The procedure for home medical reports used to be that the claimant was asked to validate the contents of the report with a signature, although I would think that the legality of this was debatable.

However, the procedure has now changed and claimants are now only asked to sign in confirmation of their identity, which appears to have been what happened with your daughter.

Hope this explains it.
