Appeals question was created by philip
I have submitted my appeal and they have sent me a letter saying they will change in my favour if they can and if not I can appeal against this decision and then they will send to tribunal. Soif they say they cannot change in my favour do they not automaticvally send to the tribunal do you have to say you appeal againgt the reconsideration before they sent the papers to tribunal ?

Hi P,
If you have submitted an appeal using form GL24, that can be downloaded from the link on this page :
How to submit an appeal
Then an automatic reconsideration will take place, if the decision is not changed at that stage, the appeal should be sent forward to The Appeals Tribunal Service, without you having to take any further action.
However, if they are inferring that you have simply requested a reconsideration, then if the decision is not change at that stage, you will have to submit an appeal then, as a seperate action.
It may be advisable to gain clarity from the DWP, as to whether they are classing your request as one for a reconsideration only, or an appeal, in which case an automatic reconsideration will take place anyway.

Thanks
I have spoken to my local advice center who have said they can help but I will have to go over. I have not gone yet as I rarely go out and would like to leave it unless I really have to go. I have put the advice center as representing me as they said they could however I have not gone yet I have my partner writing my appeal. If they never reconsidered in my favour I was then going to go to advice center ton ask to represent me at tribunal. I guess I am going to have a problem as if they dont reconsider they ust send the documnert to the advice center ?
