DLA Tribunal

Hi All, I would like to know if anyone else has made a complaint to atos for dla and the result has comeback in your favour.Then you claim has gone to tribunal and dwp have said they cannot use the medical report because you made a complaint and it was in your favour. This is what has happened to my claim, can anybody help??

Did you have a DLA tribunal hearing and if so, what was the outcome?

I have just received the papers and the medical report was not in with them and i asked the dla why the atos medical report was not in there and they have stated that because my complaint was in my favour they did not have to put this in with the papers. I do not think this is fair as they made the decision on the report and took my low rate mobility away that is why i have to go to tribunal. I have also been assesed for a blue badge which i have received and the assesment says i should be entitled to the high rate mobility, but the dwp say it has nothing to do with them...

You are entitled to all the papers that the DWP have in their file for your claim.

This from my experience must include any medical reports from ATOS.
