Gordon,

As far as I know the evidence was only received a couple of weeks after the decision had been given.

I will post back once I have finally received a copy but the TS staff seem to think it is fairly standard and really doesn't make a difference.

Like you say I would have thought they would be within their rights to refuse to consider it, though I would be happy for them to do so as I don't think it is in anyway detrimental to the case.

Hi Steve,

I have tried both DWP (twice) and am now on my second request to TS to obtain a copy of this. There is obviously some reason why they do not want me to see it although I know I am entitled to do so. I suspect it may be that it is dated and of course this gives a major clue as to when it was received and whether they deliberately did not submit it on time.

It certainly isn't pleasant but having got this far I am not going to give up as it is not in my nature !

Thanks for the good wishes, I will let everyone know how I get on, no matter how long it takes.

Thanks for your input, very interesting as I think you first statement covers my case. My fourth request to obtain copy of this evidence is now being actioned (I hope !) so when I receive this I should know exactly what date it was received.

Obviously there are no stats available but wonder how likely it is that DWP would go to such lengths just to have me appeal again against a superceded decision ?

I wouldn't put anything past the DWP these days, even if their actions are purely vexatious! :angry:

Sorry not been on here before but thought others might like to know the final outcome.

DWP tried everything including saying they had resuested a set aside even though I'd been told they had not done so by the deadline.
In the end I reached stalemate between the Tribunal service and DWP. Tribunal service sadi they must pay up but DWP said they had not heard from anyone and would not until they did. I escalated this with DWP who then managed to get the TS to send it back to the judge to try and have their original decision overturned even though they'd not lodged their request properly or in time !

So back to the judge it went which took even longer but justice prevailed. I'm sure they were not amused at being asked to re-visit this as DWP were really only arguing over payment for ONE day by this time !

Finally in March my daughters payments were re-instated and back paid.

Thank you to everyone here who gave me the incentive to keep going even when everything looked like it was going against us. Joining the site was the best money I ever spent.

I will continue to pop in from time to time and keep in touch. I know that when my daughters case comes up for review we could well end up right back at the beginning again, but knowing that these things can be persued and won gives me much more faith.

Good luck to all those who are still fighting their cases.
