Another ESA50

I have received another ESA50 form without explanation. I submitted an ESA50 enclosing medical reports in Dec. 2011 and have not received a response. You (Gordon)advised me to contact the DWP to ask for an explanation.I phoned on 26Feb and was told I would receive a phone call within 3 hours- no phone call. I wrote the next day by recorded delivery asking for an explanation urgently- no response.The deadline for the return of the new ESA50 is imminent. I feel I have no choice but to complete the form again to meet the deadline. What do you advise? Any suggestions for a cover letter? Has anyone else had this experience?

Even though it seems that there may have been an administration error in the issuing of the second ESA50, until you have something in writing confirming this, it may be advisable to return the ESA50 by the deadline given, otherwise your file may be returned to the DWP DM, and your benefit may be stopped.
I would however keep "pestering" the DWP in the mean time for answers, as to where your other ESA50 and supporting evidence is?

There is no single set review period, it can vary between 3 months and 3 years. If you manage to get hold of the paperwork relating to your claim, you should be able to find out when to expect reassessment.

My initial letter states the same re being entitled to ESA and no dates, however when my carer, hubby, rang them for a copy of the statement of reasons etc they told him the SG was only for 6 months and backdated to Dec 13th 2011. We are 'pestering' them for a confirmation letter to SG and any statement of reasons/determiming factors and score sheet,ready for the next time round. It sounds as though you to have the prelininary letter which is the one without time scales on.Ask them to sort out your confirmation letter etc which 'should' have a time scale on it. Prognosis or whatever wording they fancy using at the time.

The DWP do not as standard, include the length of an ESA award, on any Decision letter regarding the claim.It sounds as though you to have the prelininary letter which is the one without time scales on.Ask them to sort out your confirmation letter etc which 'should' have a time scale on it. Prognosis or whatever wording they fancy using at the time.
If a claimant wants to find out their likely re-assessment date then they should request their ESA85 or ESA85A medical report, depending on whether they had a medical or not. This will include the ATOS "doctors" prognosis as to when a return to work could be expected, which is normally used to set the date of the next re-assessment.
