transferd to wrag with no medical

from i b ,no medical or contact with my gp
or any other h c p . this despite a request
i made on the esa 50 for the d m to make every reasonable effort to contact the doctors who have first hand knowledge of my problems, and not rely on my ability to fill a very complicated form in.
is this legal as it seems weird that a decision about disability is left to someone who is not qualified while the only
people who would have up to date and extensive knowledge of these cases are ignored and avoided.
if anyone can help to explain whether an appeal is justified or not, or whether this
state of affairs is justthe new norm in england

Perhaps you might find the Appeals section on the FAQs page of some help in answering your question:
www.benefitsandwork.co.uk/forum?func=view&catid=10&id=70444
and specifically
How to submit an appeal.

Hi OG,
All ATOS HCP's, whether they are nurses, midwives, physiotherapists, or indeed doctors, are recognised by the DWP as Approved Disability Analysts, (ADA's)
See relevant information on the ATOS website, from the link below :
www.atoshealthcare.com/index.php?option=...ew&id=126&Itemid=425
ATOS have the contract to carry out all medical services for the DWP.
As you have been transferred to the WRAG of ESA, without having a face to face assessment, you should request a copy of your ESA85A medical report from the DWP.
You can request this from the DWP office address that appears on any letters that you have regarding your ESA.
See :
ESA medical – what forms to ask for?
& :
ESA Forms
With regards to the ESA85A and any other relevant ESA forms that you may wish to request.
As previously stated earlier in the thread, you should have a look at the appeals section in our FAQ's, accessible from here :
FAQ’s
Scroll down until you come to the appeals section.
You may also like to take a look at our :
"Employment and Support Allowance appeals" Guide, accessible from the link below :
ESA Guides
Remember, to qualify for the Support Group, you must fulfill the criteria of at least one of the SG descriptors,or qualify under the SG Exceptional Circumstances. The link below, may also be of help :
Qualifying for the Support Group
If you wish to appeal to be placed in the SG, you only have 1 month from the date of the letter informing you that you have been placed in the WRAG of ESA, see in particular :
How to submit an appeal
You can even download the GL24 appeals form from the link on the above page.
Hope this helps.
