Hiya,
My husband is in dire need of a break away, however, we are in the midst of my appeal from WRAG hopefully, to SG.
We should complete our paperwork trail, what poor stuff I have to give them in the next week or two.(Our GP /CAB people have both been off sick or on hols-we have told DWP),
Once we have submitted it all, are we allowed to go on hols. If we book a date and subsequently discover that they wish to do a ATOS meeting/apt etc when our holiday is booked, will it be a problem to cancel and rebook the apt or will it go against us in cancelling and rebooking.
I am going away for respite for a week at the end of April to my mothers as well.Will that to be a problem.

The first thing to say is that you must inform the DWP in writing that you will be away from home, this is a condition of your entitlement to ESA.
If you have had a WFI, then I would suggest you contact your JC+ advisor to let them know. WFIs are booked 7 days in advance.
Unless you are near the date of your "expected" tribunal, it is unlikely that it will be an issue, however, it may still be worth contacting the Tribunal Service to let them know when you will be unavailable. You should receive 2 weeks notice of a tribunal hearing unless you have opted for a short notice hearing.

Your husband is allowed to have a holiday, and you are allowed respite care.
All you need to do is to let the appropriate DWP office know the date(s) that you will not be be available and they will pass it to the Tribunals Service who arranges appeals.
You may wish to look at the time it is taking from submitting an appeal for ESA, to when the actual appeal will be heard, subject to Regional Variations see Delays in hearing ESA & DLA appeals
